« CONSTITUTIONAL CHALLENGE AGAINST THE MANUAL OF GOOD PRACTICES | Main | GUATEMALAN CONGRESS AGENDA FOR MAY 2nd. »

NEW REQUIREMENT OF THE PGN

It is a well known fact that the foster mothers are harassed by abusive policemen, when they go with the children they are fostering to doctors’ appointments or to the hotels to bring the children to the visiting adoptive parents. To prevent that, the lawyers have been requesting the PGN to give the foster mother an official document that would legitimize the foster care. Recently, the PGN accepted to establish a document that would prove that the child is under the care of the foster mother with the authorization of the birthmother and that a legal adoption is in process.

Prensa Libre, a newspaper whose editor is the brother in law of Wendy Berger, has been very anti adoption lately. That is the only explanation to tie to illegal acts, something that is being established for the benefit and protection of those women who care for the children being adopted, of the abuses of a some policemen that are behaving illegally.

The document with the information about the child and the adoption, is far from being a new requirement. It was established many years ago by the State Attorney and it was under the Hague fiasco that the then Attorney General eliminated that protection, leaving the foster mothers at the mercy of the policemen. We are grateful that it was established again.

The Prensa Libre also mentions the constitutional challenge that was filed against the Manual of Good Practices and quotes the comments of the State Attorney, who laments the position of the lawyers who filed it, because according to him, the Manual is for the benefit of the children. . We wonder if the Ministry of Communications would decide to enforce a Manual of Good Practices for the Media, limiting their right to express opinions without previous censorship, that the Prensa Libre owners and editor would submit themselves to that constitutional violation and would not file right away a challenge against such Manual. We believe that the newspapers abuse their power in many ways, but we rather have that than a censored press. The same applies to any endeavor in a free country. The abuses of a few do not justify the violation of the safeguards established by the Constitution. It is our obligation to demand from the State, to respect the laws that rule us all.

I am very glad to see that the fostermoms will once again have legal documentation of their status, and thus the protection that affords!
